Terms and Conditions

  1. Introduction – These Terms and Conditions govern the provision of book design and production services by Pippa Mackenzie Photography Ltd (“we,” “our,” “us”) to clients (“you,” “your”). By engaging our services, you agree to these terms.
  2. Services Provided – LIFE by Pippa Mackenzie is a bespoke book design and production service, provided by Pippa Mackenzie Photography Ltd. We offer book design and production services for clients who provide their own images, text, and other content.
  3. Client Responsibilities –
    • You must provide high-resolution images and properly formatted text in a timely manner.
    • You confirm that you have the rights to use all images, text, and other content that you supply to us.
    • If any images require editing, you confirm that you have the rights for these images to be changed.
    • You are responsible for proofreading and approving all text before submission.
    • You are responsible for thoroughly reviewing the final draft of the book, including all text, images, and design elements, before giving final approval. Any reprinting due to mistakes found after your final sign-off will incur additional costs, payable by you.
  4. Copyright and Usage –
    • We retain copyright over the book’s design, layout, and creative elements under the terms of the Copyright, Designs and Patents Act 1988.
    • The final book is for personal use only and may not be resold or reproduced for commercial purposes without our written consent.
  5. Design and Approval Process –
    • Once we have received all content from you and any agreed initial payment, we will provide a first draft design for your review within 4 weeks of starting the design process. This timeframe may change. If it does we will inform you of a new delivery schedule.
    • You are entitled to unlimited rounds of revisions as part of the agreed fee for LIFE and 2 rounds of revisions as part of the agreed fee for LITTLE LIFE.
    • Additional revisions for LITTLE LIFE may incur extra charges.
    • Final sign-off approval must be given before beginning the printing and binding process.
  6. Client Materials & Shipping –
    • You may choose to send photographs, documents, mementos, or other materials to be included in your book. Any items sent to us are done so entirely at your own risk.
    • You are solely responsible for arranging and paying for all shipping, insurance (if desired), customs duties, taxes, and any associated import or export charges when sending materials to us.
    • We accept no responsibility or liability for any items that are lost, delayed, or damaged during transit to our studio.
    • All original materials received will be returned to you once the book has been completed and delivered. You are responsible for covering all shipping costs, insurance (if desired), customs duties, taxes, and any associated charges relating to the return of these items.
    • We cannot accept liability for any items that are lost or damaged during return shipping.
  7. Payment Terms –
    • Part or full payment is due before we begin work.
    • We will agree a payment plan with you before we start work and this payment plan must be adhered to for the entirety of the project.
    • When making payment from outside the UK, you are responsible for covering all additional charges that may arise. If the money received is below the invoiced amount we will re-invoice for any outstanding money owed.
    • No printed and bound books will be delivered until full payment is received.
    • Prices are guaranteed for six (6) months from the date of the first invoice. After this period, we reserve the right to adjust pricing based on costs and market conditions.
  8. Delivery and Turnaround Time –
    • Estimated completion times will be provided at the start of the project.
    • Delays in receiving images, text, or feedback may impact the timeline.
    • Shipping costs are included for any books delivered within the UK. Delivery outside the UK will incur an additional cost which will be quoted for and require payment before any book is shipped.
    • For customers outside the UK, you are solely responsible for paying for all customs duties, taxes, and any associated import costs when your book enters your country. Any delay in paying these may delay your book from being delivered.
    • Delivery times may slip due to conditions beyond our control (e.g., supplier delays, postal disruptions, border control or other unforeseen circumstances). We will inform you as soon as possible if this happens and take reasonable steps to limit the impact.
  9. Cancellations and Refunds –
    • If work has commenced, you will be liable for any work completed up to the point of cancellation.
    • No refunds will be issued after final approval of the design.
  10. Liability –
    • We are not responsible for errors in images, text, or other content and final sign-off of the book design lies with you.
    • In the event of loss or damage of your book(s) due to our negligence, our liability will be limited to reprinting and replacing the book with a like-for-like copy.
  11. Privacy and Data Protection –
    • We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
    • We may use samples/images/video of completed work for marketing purposes (including social media, our website, and other marketing material). If you do not wish for us to do this, you must inform us in writing.
  12. Changes to Terms and Conditions – We reserve the right to update these Terms and Conditions at any time. You will be notified of any significant changes.
  13. Governing Law – These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
